How Does the TCPA Protect Consumers?
Here are some ways you can determine if the calls you are getting are robocalls
- If you receive more than four calls or voicemails from the same caller on the same day.
- If you answer the phone and there is no live person, just a recording or computerized voice.
- If you answer the phone and there is dead air on the other end.
- If you answer the phone and there is a long pause or clicking before someone comes on the line.
In addition to protecting consumers from robocalls, the TCPA also prohibits unauthorized automatic text messages and facsimiles.
How Can I Protect Myself from Unwanted Telephone Solicitations?
If telephone solicitations are driving you crazy, there are a few things you can do to protect yourself. These are as follows:
- If You Consented to the Calls, Revoke Consent: Robocalls are permissible if the consumer gave their consent to receive them. However, if the consumer is starting to get annoyed by the calls they are receiving, they can revoke consent. If the robocalls continue, the consumer is within their rights to seek legal help.
- Withdraw from Phone Calls from a Specific Caller: The Federal Communications Commission provides rules and regulations that allow people to withdraw from receiving any future automated calls. You can withdraw from receiving these calls by calling the FCC.
Get Added to the National Do Not Call Registry
A consumer can reduce the number of telemarketing calls they are getting by registering themselves on the Federal Trade Commission’s Do Not Call Registry. They can register themselves by calling 888-382-1222.
After adding themselves to the registry, consumers can expect a decrease in telemarketing calls within about 30 days. Registering can limit sales calls, however, it does not limit calls from other sorts of businesses including debt collection agencies.
